Welcome to HYPERO. The terms “we”, “us” and “our” refer to HYPERO. HYPERO operates this store and website, including all related information, content, features, tools, products and services in order to provide you, the customer, with a curated shopping experience (the “Services”). HYPERO is powered by Shopify, which enables us to provide the Services to you.

By visiting, interacting with or using our Services, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these Terms, you should not access our Services.

SECTION 1 - THE MODEL (MADE-TO-ORDER)

HYPERO operates on a sustainable, Print-on-Demand (POD) model. By placing an order, you acknowledge and agree to the following:

  • Custom Production: Every item in the drop is manufactured specifically for you after your order is confirmed. The product does not exist in a warehouse prior to your purchase.

  • Order Finality: Due to the custom nature of our production, we cannot accommodate cancellation or modification requests once an order has been sent to our fulfillment partners (typically within 2 hours of purchase).

  • Exchanges: Because each piece is custom-printed, we do not offer exchanges for size or color preference. Please consult our Size Chart carefully before ordering.

SECTION 2 - ACCESS AND ACCOUNT

By agreeing to these Terms, you represent that you are at least the age of majority in your state or province of residence. You are solely responsible for maintaining the security of your account credentials and for all of your account activity.

SECTION 3 - OUR PRODUCTS & ACCURACY

We make every effort to display the colors and textures of our garments accurately. However, please note that product appearance may differ slightly depending on your device settings and the digital rendering of the typography. Descriptions of products are subject to change at any time without notice.

SECTION 4 - ORDERS AND BILLING

HYPERO reserves the right to accept or decline your order for any reason. Your order is not accepted until we confirm acceptance and process your payment.

  • Personal Use: Purchases are for personal use only and not for commercial resale.

  • Accuracy: You agree to provide current, complete, and accurate purchase and account information. You are responsible for any shipping failures caused by incorrect address details provided at checkout.

SECTION 5 - SHIPPING AND DELIVERY

  • Production Window: Standard production for the collection takes 5-10 business days.

  • Delivery Estimates: Shipping times are estimates and are not guaranteed. We are not liable for delays caused by shipping carriers, customs, or regional logistics issues.

  • Risk of Loss: Once we transfer products to the carrier, the risk of loss passes to you.

SECTION 6 - INTELLECTUAL PROPERTY

All content included on this site, including but not limited to the HYPERO logo, the drop typography, images, and text, is the exclusive property of HYPERO or its licensors. You must not reproduce, distribute, or create derivative works of any material on the Services without our express written consent. Unauthorized use of our designs is a violation of copyright and intellectual property laws.

SECTION 7 - REFUNDS AND REPLACEMENTS

Your purchases are subject to return or exchange solely in accordance with our Refund Policy. As a custom-order brand, we only offer replacements for manufacturing defects or printing errors.

SECTION 8 - RELATIONSHIP WITH SHOPIFY

HYPERO is powered by Shopify. You acknowledge that Shopify is not responsible for any aspect of sales between you and HYPERO. You hereby release Shopify from all claims and liabilities arising from your transactions with HYPERO.

SECTION 9 - PROHIBITED USES

You may not use our products for any illegal purpose or to violate any laws in your jurisdiction. You are prohibited from using the site to harass, abuse, or infringe upon the intellectual property rights of others. We reserve the right to terminate your access to the Services for violating any prohibited uses.

SECTION 10 - GOVERNING LAW

These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of India, and any disputes will be subject to the jurisdiction of the courts in Rajkot, Gujarat.
